The Ex Post Facto Oversight by the President of the Municipal People’s Council over Building and Urban Planning Works in Algerian Legislation

This study examines the ex post facto oversight exercised by the President of the Municipal People’s Council over construction and urban planning projects in Algerian legislation. The study considers this oversight to be a mechanism for verifying compliance with legal and regulatory rules and ensuring that works conform to permits and urban planning certificates. The study aims to identify the President’s competencies in monitoring works, inspecting violations and bringing works into conformity, and to clarify the legal effects of such oversight.
Methodologically, the study takes an analytical approach, examining the relevant legal and regulatory texts. It concludes that the President occupies an important position within the ex post facto oversight system; however, the exercise of these powers overlaps with the competencies of authorised agents and other administrative authorities. Consequently, the effectiveness of this oversight clearly depends on the clear delineation of jurisdictions, proper coordination and the correct implementation of legal procedures.
